2/ Purpose and applicable documents

These terms apply to the use of CHATNOVEL. The offer displayed before subscription specifies the features included, any usage limits, the price and the billing frequency. Payment and subscription management are also governed by the terms of the store used, subject to applicable mandatory legal provisions.

CHATNOVEL's Privacy Policy separately describes the processing of personal data. The Privacy Policy is available at https://chatnovel.fr/Confidentialite-et-cookies/. The information it provides does not constitute blanket consent to all processing operations. Any necessary consent is obtained separately. Nothing in these terms limits consumers' statutory rights.

3/ Service and access requirements

CHATNOVEL allows users to read ebooks and discuss them with an AI-based conversational agent. Depending on the book, users can ask questions about the text, converse with its characters, initiate a debate between authors based on a bookshelf, take a quiz, rehearse a scene from a play, translate a passage, listen to the book being read aloud and ask the reading coach for reading suggestions. By photographing a printed book, users can start a conversation about that book if it is in the catalogue; otherwise, the application suggests books by the same author or in the same genre. Available features vary by book and may change over time.

Users must have the legal capacity required to enter into the contract. Minors use CHATNOVEL with the consent of their legal representative. Users remain responsible for their equipment and connection costs.

4/ Acceptance and user account

These terms are made available before acceptance and remain accessible at https://chatnovel.fr/Conditions-d-utilisation-de-l-application. Users may retain a copy. Information specific to their subscription is provided during the subscription process and in the confirmation supplied by the store.

Creating a CHATNOVEL account is required to add books from the catalogue and use the artificial intelligence features. Users provide, among other information, their first name, surname, country, email address and a password. Users may also use their Apple or Google account, in which case they accept these terms. Creating an account provides free access to at least one ebook selected by the user from the catalogue, within the limit indicated in the application, together with the features associated with that book. The full offering is available by subscription.

Users must provide accurate information as required and protect their login credentials. They must report any unauthorised use to the support contact. Users are not responsible for fraudulent use of their account where that use is not attributable to them.

5/ Subscriptions exclusively through the stores

For its duration, the subscription provides access to all books in the CHATNOVEL unlimited catalogue, the contents of which may change. Ebooks purchased separately on mysmartbook.fr using the same account also appear in the application.

CHATNOVEL subscriptions are purchased exclusively through the Apple App Store or Google Play. No content, chapter, credit or feature is offered for individual purchase. The available subscription plans and their access entitlements are monthly or annual.

Before confirmation, the store displays the total price, applicable taxes, currency, billing period, any minimum commitment period and renewal terms. The applicable price is the price accepted when subscribing.

Payment is processed through the selected store's checkout process. These terms do not introduce any direct payment to MY SMART BOOK. The technical information enabling CHATNOVEL to verify access entitlements, and the transaction data actually received, are described in the Privacy Policy.

6/ Activation and special offers

Access to the subscribed features takes effect in accordance with the terms stated before purchase and after the transaction has been validated. If access entitlements do not appear, users should check the store account used and contact support. Entitlements are linked to the CHATNOVEL account signed in at the time of purchase. To access them on another device, users must sign in with that account and, if necessary, use “Restore my purchases”.

A free trial or promotional price is available only if expressly stated in the offer. Its duration, eligibility criteria, subsequent price and cancellation arrangements are specified before acceptance. Users are required to check the displayed end date.

7/ Renewal and price changes

For automatically renewing plans, the subscription continues for the successive periods stated until renewal is disabled. The next billing date and subscription status can be viewed in the store. Any non-renewing plan, if offered, must be identified as such before purchase.

Any price change is communicated in accordance with the store's rules and applicable law, with the user's consent obtained where required. Users can prevent future renewals by cancelling within the stated deadlines. No new price is applied retrospectively to a period already paid for.

8/ Cancellation and end of access entitlements

Users may disable renewal in the store that collected payment for their subscription. They must use the Apple or Google account associated with the purchase and check the confirmation and effective end date. An ordinary cancellation request stops future renewals; it does not, in itself, constitute a request to exercise the right of withdrawal or obtain a refund.

  • Apple: Device Settings > account holder's name > Subscriptions > ChatNovel > Cancel Subscription. Available options may vary depending on the device and country.
  • Google Play: Open the subscriptions associated with the Google Play account, select ChatNovel and follow the cancellation instructions. Check that the correct Google account is selected.

Access normally remains available until the paid period expires, subject to the offer's rules, particularly for certain trials, a refund or a lawful ground for early termination. The terms displayed by the store specify the effect of cancellation. Uninstalling the application does not cancel the subscription. Deleting a CHATNOVEL account must not be treated as cancellation of the store subscription: users must also take action in the store.

Cancellation during a billing period does not, in itself, entitle the user to a pro rata refund. Rights of withdrawal, statutory guarantees, refunds required by law and any more favourable store terms remain applicable. When the subscription ends, books in the Unlimited catalogue are no longer accessible, including offline, except for the complimentary book.

9/ Right of withdrawal

Under applicable regulations, users residing in the European Union are, in principle, entitled to withdraw within 14 days of subscribing to CHATNOVEL.

This right may be subject to exceptions provided for by law, particularly where the supply of digital content begins immediately with the user's express consent and the statutory conditions for waiving the right of withdrawal are met.

As CHATNOVEL subscriptions are purchased exclusively through Apple's App Store or Google Play, users may submit withdrawal or refund requests to the platform through which they subscribed, following the procedures offered by that platform.

These procedures do not affect the mandatory rights granted to consumers under applicable law.

10/ Requests and refunds

For purchases billed by Apple, refund requests may be submitted at reportaproblem.apple.com. For Google Play, use the refund request process associated with the purchase or the contact methods indicated in Google Play Help. Eligibility depends, among other things, on the country, the type of supply and the reason given.

Where a right of withdrawal applies, the decision must be communicated unambiguously to the relevant trader before the deadline expires, using the methods indicated in the subscription confirmation. MY SMART BOOK may be contacted to identify the appropriate recipient; this assistance does not replace notification to the recipient required by law.

Refunds required by law are made within the time limits and using the procedures prescribed by applicable law. Under French law, a refund following withdrawal is, in principle, made no later than fourteen days after the trader is informed, using the same payment method unless expressly agreed otherwise in accordance with the law. No refund fee may be charged where prohibited by law.

11/ Permitted use and content

Subject to the rights granted by the offer, users have a personal, non-exclusive and non-transferable right to use the application. Unlawful use, infringement of third-party rights, introduction of malicious software, circumvention of safeguards and unauthorised access are prohibited. Statutory exceptions, particularly those relating to software, remain unaffected.

Where the application allows content to be entered or transmitted, users must hold the necessary rights. Users remain responsible for content they share outside the application. They retain their rights in their contributions. MY SMART BOOK may use those contributions only to the extent necessary to provide the requested features, without any general transfer of ownership or authorisation to train AI models.

Users who import their own files warrant that they hold the rights necessary to read them.

CHATNOVEL's own elements, such as software, text, graphics and trademarks, are protected under applicable law. Reproduction or distribution outside the permitted uses requires MY SMART BOOK's consent.

12/ Artificial intelligence features

Our conversational agent's features rely on AI. Results may contain errors, inconsistencies or similarities to existing content. Responses attributed to a character or author are generated by AI from the book; they are not actual statements by the author or publisher. Users must assess them in light of their intended use. These limitations do not release MY SMART BOOK from its contractual commitments or statutory conformity obligations.

MY SMART BOOK does not use user data to train artificial intelligence models and requires its service providers to comply with the same restriction. Requests are processed by an AI provider identified in the Privacy Policy. Feedback on responses is used to improve the service.

13/ Availability and statutory guarantees

MY SMART BOOK provides the agreed features and updates required by law, including those necessary to maintain conformity and security. Maintenance may temporarily affect access; foreseeable interruptions are announced where possible. This clause does not permit the arbitrary withdrawal of a paid service.

Where French law applies, consumers benefit from the statutory guarantee of conformity for digital content and digital services provided for in Articles L224-25-12 et seq. of the French Consumer Code. For continuous supply, the trader is liable for any lack of conformity arising during the contractual supply period. Consumers may request that conformity be restored free of charge and, in the circumstances provided for by law, a price reduction or termination of the contract. These rights do not depend on a commercial guarantee.

14/ Liability and suspension

Each party is liable for damage attributable to it in accordance with applicable law. No clause excludes liability that cannot legally be limited or deprives consumers of redress where the trader breaches its obligations. An event of force majeure is assessed against the statutory requirements and is not presumed solely because a technical failure has occurred.

In the event of unlawful use, an established security risk or a sufficiently serious breach, MY SMART BOOK may restrict or suspend access where necessary and proportionate. Except in emergencies or where prohibited by law, users are informed of the reason and may submit observations or remedy the breach. They may challenge the measure by contacting [email protected]. Suspension does not automatically result in forfeiture of amounts paid; the effects on paid periods and statutory rights are assessed in light of the circumstances.

15/ Account deletion and changes to the service

Users may delete their account at any time from the CHATNOVEL application (the “Moi” tab). Deletion is permanent: it removes the account, library, conversations, bookshelves, quizzes, rehearsals and associated reading data. It does not cancel a subscription purchased through the App Store or Google Play, which users must cancel in the relevant store.

As the account is shared with mysmartbook.fr, deleting it also removes access to ebooks purchased on that website.

Changes to these Terms of Use are communicated together with their effective date and appropriate advance notice. Any substantial change to the paid service complies with the statutory requirements regarding grounds for the change, information on a durable medium and, where required, termination without charge. Continued use does not automatically constitute acceptance of a new obligation requiring express consent.

16/ Complaints and disputes

In the event of a dispute concerning these Terms of Use, you undertake to contact us to seek an amicable resolution. To this end, you must send us a complete, substantiated and documented account of your complaints. If no amicable solution can be reached through discussions within one month of receipt of a complete file or the last item completing it, the dispute will be considered unresolved.

If you are acting as a consumer, you may submit the dispute to mediation by writing to CM2C – 49 rue de Ponthieu – 75008 Paris, France; telephone: 01 89 47 00 14; website: https://www.cm2c.net/declarer-un-litige.php; contact: [email protected], after notifying us in writing of your decision. Mediation is one of the amicable dispute resolution methods (MARD), which also include conciliation, direct negotiation or negotiation between lawyers, settlement, the French participatory procedure and, in some cases, arbitration. In the event of a cross-border dispute in Europe, consumers may contact the European Consumer Centre (ECC).

An unresolved dispute may be brought by the first party to take action before the competent French courts in accordance with domestic procedural rules. If proceedings are initiated by a non-resident or a foreign national, jurisdiction shall lie with the Paris Judicial Court (Tribunal judiciaire de Paris), including applications for preparatory, provisional or urgent measures, applications without notice, interim proceedings or similar relief.
